Ickity App Terms of Service

This agreement is between you and Jason Cook, doing business as (d/b/a) Jelly Software (hereinafter referred to as 'we', 'us', or 'our'), the creator of the Ickity application. 1. NATURE OF SERVICE & DISCLAIMER Ickity is a digital journaling utility and reality-tracking tool. It is NOT a medical, clinical, psychological, psychiatric, legal, or financial advisory service. The application does not perform clinical diagnoses, nor does it provide formal advice or treatment. The content generated or stored within this application is for informational and organizational purposes only. By using Ickity, you agree that you are not receiving professional counsel of any kind. If you are in immediate danger or a crisis situation, please contact local emergency services or a qualified professional immediately. 2. ELIGIBILITY You must be at least 16 years old to create an Ickity account and use this application. Ickity is not directed at children, and we do not knowingly collect information from anyone under 16. If you believe a minor has created an account, contact us at the support address below and we will delete it. 3. USER RESPONSIBILITY & DEVICE SECURITY You assume full, sole, and absolute responsibility for the security of your device and the information stored within Ickity. You acknowledge that Ickity is installed on your local hardware. While Ickity provides encrypted storage and an optional PIN lock, these features do not guarantee total immunity from unauthorized access. You are responsible for keeping your device secure, choosing a strong PIN, and preventing unauthorized physical access to your phone. Furthermore, if you opt to utilize operating system-level biometric authentication (such as Apple Face ID, Touch ID, or Android Biometrics) to unlock Ickity, you acknowledge that these mechanisms are controlled entirely by your device manufacturer. We bear absolutely no liability for unauthorized access resulting from coerced, forced, or non-consensual biometric scans, including instances where you are asleep, incapacitated, or under duress. The developers of Ickity bear no liability for the discovery, interception, or physical disclosure of your journal entries by third parties, co-parents, household members, or any other individual or entity who gains access to your device. 4. RELATIONSHIP DECISIONS & RIPPLE EFFECTS You acknowledge and agree that Ickity is merely a writing, recording, and organization tool. Any choices or actions you take regarding your personal relationships—including decisions to pursue "no contact," "low contact," or any legal, social, financial, or familial ripple effects that occur as a result of your own findings, records, or reflections—are made entirely at your own discretion and risk. We bear zero responsibility or liability for the outcomes, consequences, or fallout of any interpersonal and personal decisions you make. 5. GLOSSARY OF TERMS & BEHAVIORAL DEFINITIONS The psychological and behavioral terms provided within the Ickity application glossary are strictly for personal documentation, pattern recognition, and educational purposes. They do not constitute clinical, medical, or legal definitions, nor are they intended to diagnose any individual or condition. If you are experiencing abuse, please consult a licensed medical professional, therapist, or local authority. Ickity is a documentation tool, not a substitute for professional psychological help. Any connections, conclusions, or labels you assign to individuals based on these terms are strictly your own interpretation and responsibility, and carry no connection, endorsement, or validation from us or our product. 6. AUDIO RECORDING & WIRE TAPPING LAWS By using the acoustic recording features within Ickity, you assume full responsibility for complying with all local, state, federal, and international audio recording laws. Certain jurisdictions require "two-party consent" or "all-party consent" to record conversations. You explicitly agree that you will not use Ickity to illegally record individuals without required consent, and you hold the developers completely harmless from any legal action resulting from your recordings. 7. AI TRANSCRIPTION & ACCURACY Ickity uses on-device AI models to transcribe audio and to index your entries on your device. AI transcriptions are provided "as-is." We do not guarantee 100% accuracy, and the AI may occasionally misinterpret audio or generate errors. You are solely responsible for reviewing and verifying the accuracy of all transcriptions before relying on them for any personal, legal, or organizational purpose. 8. SUBSCRIPTIONS, PAYMENTS, & CANCELLATIONS Ickity is offered as an auto-renewing subscription. Your subscription renews automatically at the end of each billing period unless you cancel it at least twenty-four (24) hours before the end of the current period. The price and billing period are shown to you before you purchase, and again in your device's subscription settings. All subscription purchases, renewals, and cancellations are securely managed and processed entirely by the platform where you downloaded this application (Apple App Store or Google Play Store). We do not directly process payments or store credit card information. Cancellations must be made through your device's native subscription settings. Any refund requests must be directed to Apple or Google and are completely subject to their respective Media Services Terms and Conditions. 9. YOUR ACCOUNT AND YOUR DATA Your entries belong to you. You may read, search, edit and copy your own entries at any time, including after a subscription ends. Exporting a complete archive with your media attachments is a subscription feature. You may delete your account at any time from Settings. Deleting your account removes your name, email address and phone number from our systems. Your entries are stored on your own device and in your own personal cloud account (such as iCloud), never on our servers, so deleting the app or your account does not delete entries you have backed up yourself — those remain under your control, and you remove them the same way you would remove any other file. 10. RIGHT TO TERMINATE We reserve the right, in our sole discretion, to suspend or terminate access to Ickity for conduct that we determine violates these terms — including software tampering, reverse engineering, circumvention of subscription controls, attempts to compromise the security of the application or other users, or harassment of our staff. Where we terminate an active paid subscription for such conduct, you may request a pro-rata refund of the unused portion through Apple or Google. Nothing in these terms restricts your right to publish honest reviews, criticism, or opinions about Ickity, and we will never penalize you for doing so. 11. LIMITATION OF LIABILITY To the maximum extent permitted by law, the creators, developers, and affiliates of Ickity shall be held completely harmless from any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use this software. This includes, but is not limited to, damages for loss of privacy, emotional distress, data loss resulting from device damage, or personal fallout arising from the use of the information contained within your entries. 12. PRIVACY & DATA COLLECTION Ickity operates on a "Local-First" architecture. Your entries and audio recordings are encrypted and stored exclusively on your local device. We do not transmit or store your journal narrative data on our servers. For billing, authentication, and licensing purposes, we collect only your name, email address, and an optional phone number. By signing up, you consent to our collection of these specific credentials, anonymous crash reports, and anonymous usage analytics used to improve app stability and decide what to build next. Our full Privacy Policy describes exactly what those contain. 13. MARKETING COMMUNICATIONS By creating an account, you consent to receive periodic emails from Ickity regarding product updates, resources, and administrative notifications. You retain the absolute right to opt out of marketing communications at any time via the "unsubscribe" link provided in each email. 14. CHANGES TO THESE TERMS We may update these terms as the application changes. When we do, we will update the date at the top of this document and make the revised terms available in the application. Continued use of Ickity after a change means you accept the revised terms. If you do not accept them, you may stop using the application and delete your account from Settings. 15. ACCEPTANCE OF TERMS By checking the box and clicking "Create Secure Account," you acknowledge that you have read, understood, and explicitly agree to be bound by these Terms of Service and Legal Disclaimer.
